Privacy Notice

It is our aim through this PEPSICO GATORADE SPORTS SCIENCE INSTITUTE (“GSSI”) UNITED STATES PRIVACY NOTICE (“Notice”) to explain what personal information PepsiCo, Inc. and its subsidiaries and affiliates (collectively, “PepsiCo,” “we,” “our,” or “us”) collect about you via the GSSI Labs mobile application (“GSSI app”) and why we collect that information. We also want to make sure you understand how we use and share your personal information and the choices available to you. Our goal is to earn and keep your trust as you use the GSSI app.
This Notice describes how we treat personal information collected from the GSSI app. This Notice does not describe our practices on sites or apps where it is not referenced. For example, this Notice does not apply to when you visit or your use of Gatorade.com.
We may provide additional privacy notices to individuals at the time we collect their data. For example, we provide a specific privacy notice to clinical research participants that describes our privacy practices in connection with conducting clinical research. This type of an “in-time” notice will supplement this Notice for the personal information you provide in connection with clinical research. Supplemental notices will prevail in the event of any conflicts with this Notice.
Your use of the GSSI app indicates you agree to our collection, use, and sharing of your personal information as set forth in this Notice.
I. What information do we collect?
The categories of personal information that we may collect about you when you use the GSSI app, some of which may be considered sensitive personal information under applicable law, include:
We collect identifiers and contact information. For example, we may collect your name and street address when you register for the GSSI app. We may also collect your phone number, email address, and any username and password used to register for the GSSI app. We also collect online identifiers. For example, if you engage with us through a social media site, we may collect your social media user identifier.
We collect biological and demographic information and information about your interests. We may collect information such as your gender, race, ethnicity, age, household or lifestyle information, and your zip code. We may also collect information about your weight and height.
We collect information related to your health. We may collect information such as your past and current health or condition, whether you are taking medications, or whether you have allergies.
We collect physiological information and other information tied to your wearable device. We may collect information about your vital signs, bodily functions, or measurements, including from your wearable device, such as heart rate, sleep patterns, steps taken, blood pressure, blood glucose, blood oxygen, ECG, and respiratory rate.
We collect internet and electronic network activity information, such as device and usage information. We may collect information about your operating system, Internet Service Provider (ISP) information and IP addresses and other device identifiers, such as mobile device identifiers. In addition, we may collect information about your use of the GSSI app, including through use of tracking technologies such as Google Analytics. We collect geolocation information, including precise geolocation. Using technologies such as GPS or Wi-Fi, we may collect information about your location, including that which provides your precise location. For example, if you use our mobile apps, we may access your device’s location information to provide you location-enabled features.
Transaction and rewards program data. If you utilize the rewards features of the GSSI app, we may collect information about your interactions and use of the rewards features, such as whether you have redeemed a gift card.
We collect other information you submit or authorize us to collect. We collect any other information you may provide to us or authorize us to collect, including through in-app surveys. This may also include information about your physical activities or your nutrition habits or preferences.
II. How do we collect information?
We collect personal information directly from you, including when you:
- Register for and use the GSSI app.
- Participate in rewards or other features of the GSSI app and related programs.
- Link your wearable device to your account in the GSSI app.
- Fill out a survey.
- Contact us.
- Otherwise submit it to us.
We collect information from you passively. We use tracking tools like Google Analytics and mobile device IDs, including to track information about your usage of the GSSI app over time. We may also collect information from your mobile device, such as the date and time that you log activities. We may also have third parties collect personal information this way.
Third parties may also share information about you with us. For example, we may collect information from third-party wearable devices, if you consent to linking the wearable device to the GSSI app. Our business partners may also give us information about you.
III. We may combine information from different sources
We may combine information. For example, we may combine personal information we have collected about you offline with information we collect online. We combine information across devices such as computers and mobile devices. We may also combine information from third parties with information we already have.
We may use the personal information that we collect to provide you with the GSSI app and otherwise as permitted by law, including as follows:
We may use information to help us effectively provide you products and services. For example, we may use your information to process your registration with the GSSI app and to respond to your questions. We may also use your personal information to provide you with relevant rewards and program features. We may also use your personal information for our business purposes in connection with providing the GSSI app, such as administering the GSSI app and performing our contractual obligations.
We may use information to improve our products and services. One of our goals is that you have a positive experience with the GSSI app. Therefore, we may use your personal information to improve your experience with the GSSI app and other relevant offerings. We may do this by analyzing your use of the GSSI app. We also might use your information to personalize your experience with us.
We may use information to facilitate your enrollment in clinical research studies. We may use your personal information to facilitate enrollment in clinical research studies. Participation in clinical research studies is optional, meaning that you do not need to participate to access the app.
We may use information for security and safety purposes. We may use your personal information to help protect you, our sites and apps, our company, our customers, and our consumers, such as for fraud prevention, and to investigate and prosecute users who violate our rules or who engage in behavior that is illegal or harmful to others or to others’ property.
We may use information to get feedback from you about how we’re doing and for other transactional purposes. We may contact you about this Notice or the Terms of Use posted to the GSSI app you are using.
We may use information as the law allows us or as we may notify you. We may process your personal information to comply with laws and regulations. We may also use personal information to monitor compliance with our policies and procedures or for other purposes with your consent.
We may use your information for other purposes where we provide you notice or secure your consent. We may use your personal information for any other purposes we otherwise disclose to you, such as when you are interacting with the GSSI app, or with your consent.
We may also aggregate and/or deidentify your information. In addition to the uses of personal information described above, we may aggregate and/or deidentify personal information that we collect, such that the information no longer relates to any individual.
V. How we may share information we have collected
We may share the categories of personal information listed above to provide you with the GSSI app and as permitted by applicable law, including with:
We may share information with third-party vendors. We may share information with companies who serve as our vendors or third parties who perform services on our behalf. They may help us deliver products or services to you. For example, we may share information with companies who assist with the operation of the GSSI app or features.
We may share information within the PepsiCo family of companies and brands. This includes current and future PepsiCo subsidiaries, affiliates, and joint venture partners and with third parties with which we have an ownership interest or commercial relationship, such as companies whose products we distribute.
We may share information with select business partners. For example, we may share information with partners, and your information may be collected by both us and the third party. Your information will be used by us as described in this Notice or by partners as described in their policies.
We work with analytics partners. The GSSI app may use analytics, through which our partners may collect internet and electronic network activity information, such as device and usage information. For additional information, please visit our About Our Ads policy.
We may share information with researchers. For example, we may share information to facilitate enrollment in clinical research studies.
We will share information if we think we must in order to comply with the law or to protect our company. For example, we will share information to respond to a court order or subpoena. We may share information if a government agency or investigatory body requests it. This includes United States and non-United States law enforcement or regulatory authorities. We may also share information if we are investigating potential fraud, security incidents, identity theft, harassment, and other illegal activity.
We may share information with any successor to all or part of our business. For example, if part of our business is sold we may include your information as part of that transaction, or in the event of insolvency, bankruptcy or receivership.
We may share information as we otherwise notify you or with your consent. We may use your personal information for any other purposes we otherwise disclose to you, such as when you are interacting with the GSSI app, or if we request consent to share your personal information.
Our sharing of personal information accords with applicable law and we will seek your consent where appropriate.
VI. You have certain choices about how we use your information

You can control tools on your mobile devices. For example, you can turn off the GPS locator or push notifications on your phone. To modify the push notifications you get from our app, you can alter your preferences in your profile.
You may have other choices under applicable state laws. Depending on where you live, you may have certain additional rights, as described below. We only honor these rights where required by law.
- You may have a right to request to confirm whether or not we process your personal information as well as to access and receive a copy of the specific personal information we have collected about you in a portable format.
- You may have a right to request deletion of your personal information.
- You may have a right to request correction of any inaccurate personal information we hold about you.
- You may have the right to opt out of the sale, sharing or targeted advertising of personal information to third parties.
- In some circumstances, you may have the right to opt out of automated decision making and profiling, such as where it produces legal or other significant effects.
- You may have the right to opt-out of the processing (or limit the use) of your sensitive personal information or withdraw consent to process your sensitive personal information.
- You have a right not to receive discriminatory treatment for exercising any of your rights described under this section.
These additional rights are subject to exceptions under applicable laws. For example, we may not be able to honor certain rights requests without taking reasonable steps to verify your identity.

Where permitted by law, we may reasonably verify your request by asking you to provide information to confirm your identity. This information may vary depending on your relationship with us. If you are a consumer in a jurisdiction that recognizes the ability to use an authorized agent and wish to contact us through an authorized agent, we may request evidence that you have provided such agent with power of attorney or that the agent otherwise has valid written authority to submit requests to exercise rights on your behalf.
If you are in a jurisdiction that recognizes your ability to appeal a decision we have made in connection with your attempt to assert a right under applicable laws, you may submit a request to appeal through our secure web portal.
Please provide the state that you are writing from, accompanied with information you may have regarding the matter you are appealing. If your jurisdiction allows you to file a complaint with the state’s Attorney General’s Office regarding any concerns with the result of your appeal request, you may do so by using their online properties.
How we may sell or share your personal information
We do not sell your personal information for money or share your personal information for targeted advertising.

VII. Retention of personal information
We keep the categories of personal information described above for as long as is necessary for the purposes described in this Notice or otherwise authorized by law. This generally means holding the information for as long as one of the following apply:
- Your personal information is reasonably necessary to manage our operations, to manage your relationship with us, or to satisfy another purpose for which we collected the information;
- Your personal information is reasonably necessary to carry out a disclosed purpose that is reasonably compatible with the context in which the personal information was collected;
- The information is reasonably required to protect or defend our rights or property (which will generally relate to applicable laws that limit actions in a particular case); or
- We are otherwise required or permitted to keep your information by applicable laws or regulations.
VIII. Children's privacy
It is not our intention to collect personal information from children under age 13. If you are a parent or legal guardian and think that your child under 13 has given us information, you can contact us at https://contact.pepsico.com/pepsico/contact-us and we will take appropriate steps. IX. Security measures
We use various technical and organizational measures and mechanisms to secure the GSSI app. You should understand that no data storage system or transmission of data over the Internet or any other public network can be guaranteed to be perfectly secure.
X. The GSSI app is intended for a United States audience
If you live outside of the United States and choose to use the GSSI app, you understand that it is at your own risk. You also understand that your information will be sent to and stored in the United States. The United States may not afford the same level of protection as laws in your own country.
XI. We may link to other sites or apps or have third-party services and tools on our platform we don't control
We may link to or allow you to access the GSSI app from third-party websites or platforms. Our sites and apps may also include third-party content that collects information. Third-party content may include tools like cookies and tracking technologies. This may include analytic purposes. We do not control these third parties or their use of these technologies, so please read their privacy policies carefully.
XII. We may update this notice
From time to time, we may change this Notice. When we do, we will notify you of any material changes as required by law. This may include posting an updated copy here and updating the “Last Updated” date. Please check this Notice periodically for updates.
XIII. California specific notices
California “Shine the Light” Law
If you reside in California, you have the right to ask us one time per year for information about our disclosure, if any, of personal information to third parties for their direct marketing purposes in the preceding calendar year. Indicate in your letter that you are a California resident making a “Shine the Light” inquiry. We reserve our right not to respond to requests submitted other than by the means specified in this section, if the request is not labeled or sent properly, or if the request does not have complete information.
California Consumer Privacy Act (“CCPA”)
We have explained our privacy practices in full in the other sections of this Notice. In this section, we provide a list of categories of personal information, as set forth in the CCPA, that have been collected, disclosed for business purposes, shared for cross-context behavioral advertising, or sold for commercial purposes during the preceding 12 months, as well as certain other supplemental information. Some of these categories of personal information that we collect may include information that is considered sensitive under the CCPA.
Please see the other sections of this Notice for additional information about our practices and your rights. The personal information we collect about you may include information within the below noted categories of data. While the categories are as defined under California law, the disclosures below also apply to residents of other states as well.

As discussed in the other sections of this Notice, we collect these categories of information from you, through our interactions with you and others, and from third-parties, and we disclose these categories of personal information within the PepsiCo family of companies and brands, to business partners and third-party vendors that provide us hosting and other services, to analytics partners, and as needed to comply with legal process.
Your personal information may also be disclosed to third-parties with whom you interact and third parties that you direct us to disclose your information to through the GSSI app. We may also disclose personal information with third-parties in various additional ways, as described elsewhere in this Notice.
In California, you may have certain additional rights under applicable law, in addition to your rights to access, correct, and delete your personal information as described above. In California, you also may have:
- The right to request other information about our data processing practices, including the categories of personal information that have been collected about you; the categories of sources from which personal information are collected; our business or commercial purpose for collecting, using, disclosing, selling or sharing personal information; the categories of third parties with whom we disclose, sell or share personal information; and the categories of personal information we have disclosed, sold or shared about you for a business purpose.
- The right to direct us to limit the use and disclosure of your sensitive personal information to certain uses and disclosures, such as those that are reasonably necessary to provide our goods and services or as needed to ensure security and integrity, to prevent fraud or illegal activity, or for physical safety.

Sale or Sharing. We do not sell your personal information for money or share your personal information for cross-context behavioral advertising.
To the extent we collect precise geolocation information for purposes of performing a service you have requested, we may be deemed to be collecting data that is “sensitive” under California law. Our use of this data for performing a Service you have requested is consistent with the permitted business purposes in California Civil Code § 1798.100 et seq. and implementing regulations.

XIV. Rewards Program
As part of the GSSI app, we offer rewards points for completing different activities within the GSSI app. Participation in these activities may require you to provide personal information, such as name, email address, information about your health and exercise habits, and other personal information described above in the section “What information do we collect?,” which we use for the other purposes described in this Notice. For the full terms and conditions, please review the Terms and Conditions for the GSSI app.
The incentives associated with this rewards program are designed to reward your completion of activities within the GSSI app rather than the value of your personal information. Based on our reasonable and good faith estimate, we receive value from this rewards program, including from increased engagement with our brands and scientific research. Because some of the GSSI app’s features and surveys involve linking your wearable devices and gathering information about your physical activity and health, it may be necessary to collect and process sensitive personal information from you as part of your participation.
You have the right to cancel your participation in this rewards program by contacting us as indicated below. You also may delete the GSSI app at any time.

This Consumer Health Data Privacy Policy (“Policy”) describes the privacy practices of PepsiCo, Inc. and its subsidiaries and affiliates (collectively, “PepsiCo,” “we,” “our,” or “us”) with respect to consumer health data as defined in Washington’s My Health My Data Act and other similar state laws that is collected by the Gatorade Sports Science Institute (“GSSI”) Labs mobile application (the “GSSI app”). This Policy supplements our Privacy Notice, which describes how we treat personal information collected by the GSSI app to provide additional information about our handling of consumer health data. This Policy does not apply to when you visit or your use of Gatorade.com.
From time to time, we may change this Policy. When we do, we will notify you of any material changes as required by law. This may include posting an updated copy here and updating the “Effective Date” date. Please check this Policy periodically for updates.
We may provide additional privacy notices to individuals at the time we collect their data. For example, we provide a specific privacy notice to clinical research participants that describes our privacy practices in connection with conducting clinical research. This type of an “in-time” notice will supplement this Policy for the consumer health data that you provide in connection with clinical research. As described in our Privacy Notice, we collect personal information from a number of sources, including directly from you when you:
- Register for and use the GSSI app
- Participate in rewards or other features of the GSSI app and related programs
- Link your wearable device to your account in the GSSI app
- Fill out a survey
- Contact us
- Otherwise submit it to us
We also collect personal information:
- Passively, through tracking tools such as Google Analytics
- From third parties, such as our business partners
Some categories of personal information that we collect could also be considered consumer health data, such as:
- Physiological information including information about your vital signs, bodily functions, or measurements, such as your heart rate, sleep patterns, steps taken, blood glucose, blood oxygen, ECG, respiratory rate, height and weight, and blood pressure, to the extent such information identifies your past, present, or future health status.
- Biographical and demographic information, to the extent such information identifies your past, present, or future health status.
- Information related to your past and current health or condition, whether you are taking medications, or whether you have allergies.
- Internet and other electronic network activity information, such as through automated means, to the extent such information identifies your past, present, or future health status.
- Other personal information that identifies or may be used to identify your past, present, or future health status.
How We May Use Consumer Health Data
We may use consumer health data for the purposes described in our Privacy Notice, including as reasonably necessary to effectively provide and maintain the products and services you request from us. This includes to operate our business and services; analyze the use of our products and services; to facilitate your enrollment in clinical research studies; and for safety and security purposes. We may also combine your consumer health data from third parties with information we already have. We may also use your consumer health data for other purposes with your consent and as otherwise permitted or required by law.
How We May Share Consumer Health Data
We may share the categories of consumer health data listed above as reasonably necessary to provide you with requested products or services. Where permitted by law, the types of individuals or entities to whom we disclose consumer health data include:
- The PepsiCo family of companies and brands (as listed here)
- Third-party vendors that perform services on our behalf
- Select business partners
- Analytics partners
- Researchers
We may also share your consumer health data with your consent.
Unless prohibited by applicable law, we may share consumer health data with any successor to all or part of our business. For example, if part of our business is sold we may include your information as part of that transaction, or in the event of insolvency, bankruptcy or receivership.
In addition, we may share consumer health data if we think we must in order to comply with the law or to protect our company. Your Rights
Applicable law may give you certain rights with respect to your consumer health data, including rights to know, access, request changes, delete, or withdraw consent relating to our use of your consumer health data, subject to certain exceptions.
